Terms of Service

1. Acceptance of these terms

By accessing or using EmpowerQuotes (the "Service"), operated by EmpowerQuotes, Inc. ("we", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service you represent that you are 18 or older. If you create an account on behalf of a business, you represent that you have the authority to bind that business to these terms.

3. Accounts and security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at admin@empowerquotes.com if you suspect unauthorized access. We may suspend or terminate accounts that violate these terms or that pose a security risk to other users.

4. How the Service works

EmpowerQuotes is a marketplace that connects customers seeking local services with verified local businesses. We facilitate matching and communication between the two sides. We are not a party to the underlying service agreement between a customer and a business, do not provide the services ourselves, and do not endorse, guarantee, or warrant the work performed by any business on the platform.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or to facilitate unlawful activity.
• Misrepresent your identity, your business, or the work you perform.
• Post false, misleading, or fraudulent quotes, requests, or reviews.
• Attempt to scrape, reverse-engineer, or otherwise extract data from the Service except as expressly permitted.
• Use the Service to harass, defame, or harm other users.
• Circumvent the platform to avoid fees by completing matched work off-platform when our fees would otherwise apply.

6. Fees and billing

The Service is free for customers seeking quotes. You will not be charged by EmpowerQuotes for posting requests, receiving quotes, or selecting a business. You pay the business you choose directly.

Businesses pay a monthly subscription of $249 USD to participate, billed in advance. New business accounts begin with a 14-day free trial; cancel before the trial ends and you will not be charged. After the trial, your subscription renews automatically each month until you cancel. Cancellation takes effect at the end of the current billing period; we do not provide pro-rated refunds for partial months. All billing is processed by Stripe.

We may change subscription pricing with at least thirty days notice. Continued use after a price change is acceptance of the new price; if you do not agree, you may cancel before the change takes effect.

7. Verification

Businesses must complete identity and category verification before they can quote on customer requests. We may revoke verification status at any time if we determine a business no longer meets our standards or has violated these terms.

8. Termination

You may cancel your account at any time from your dashboard or by emailing admin@empowerquotes.com. We may suspend or terminate your account for violation of these terms, non-payment, or to comply with law. On termination, your right to access the Service ends; provisions that by their nature should survive (including ownership, disclaimers, limitations of liability, and dispute resolution) will survive.

9. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free, that any defects will be corrected, or that any business listed on the platform will perform satisfactorily. Hiring decisions and the quality of work performed are your responsibility.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, EMPOWERQUOTES, INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. Our aggregate liability for any claim arising out of these terms will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose or (b) one hundred US dollars.

11. Indemnification

You agree to defend, indemnify, and hold harmless EmpowerQuotes, Inc. from any claim, demand, loss, or expense (including reasonable attorneys fees) arising out of your use of the Service, your violation of these terms, or your violation of any rights of a third party.

12. Governing law and jurisdiction

These terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any action arising out of or relating to these terms will be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to the personal jurisdiction of those courts.

Note: jurisdiction is set based on the operating location of EmpowerQuotes, Inc. Update if our principal place of business changes.

13. Changes to these terms

We may update these terms from time to time. Material changes will be announced by email or in-app notice. The updated terms take effect on the date posted at the top of this page. Continued use of the Service after that date means you accept the updated terms.
